Shimla: The Himachal Pradesh High Court has established a major legal principle regarding the promotion and seniority of government employees. The court ruled that the date a departmental examination result is uploaded to an official website will be considered the official date of passing the exam.
It further clarified that administrative delays in publishing official notifications in the government gazette cannot be used to deny eligible employees their due promotion and seniority. This decision was delivered by the bench of Justice Jia Lal Bhardwaj while accepting a petition filed by petitioner Vijay Kumar Sharma.
According to the background of the case, the petitioners had challenged the Under Secretary seniority lists issued by the state government in 2011 and 2012. The petitioners appeared in a departmental examination held in September 2008 and passed it successfully. The result of this exam was uploaded to the department’s official website on October 1, 2008. However, the government delayed issuing the joint official notification of the result, releasing it on November 11, 2008.
During this period, posts for Under Secretary became vacant on November 4, 2008. While initiating the promotion process, the department declared the petitioners ineligible, arguing that their results had not been officially notified by November 4. Due to this administrative stance, junior employees were promoted against the 2008 vacancies, while the petitioners were pushed to the 2009 vacancies despite passing the exam earlier.
Hearing the petition, Justice Jia Lal Bhardwaj rejected the administrative department’s approach. Interpreting the law, the High Court clarified that after the implementation of the Information Technology (IT) Act, any information provided through digital means is completely valid and legally binding.
The court held that as soon as the departmental exam result was posted on the official website on October 1, 2008, it entered the public domain. At that exact moment, the petitioners acquired the necessary legal qualification for promotion. The employees cannot be made to lose their seniority due to delays in publishing the notification in the gazette. Following this judgment, thousands of state government employees will gain direct legal protection in matters related to promotion and seniority.
