In another X post, Ratna Singh stated that the Executive Magistrate court has released Abhijeet, Saurav and Ashutosh on the condition that they must not breach the peace for one year.
Delhi Court Rejects Plea Against Police Action
The development comes a day after a Delhi court dismissed an application filed on behalf of Ratna Singh that sought the registration of a First Information Report (FIR) or a Non-Cognisable Report against police personnel.
The plea alleged that Singh had been wrongfully confined and illegally prevented from attending a planned demonstration against Chief Election Commissioner Gyanesh Kumar on October 10. The application had further requested the court to direct the police to submit a status report and prayed for her immediate release.
However, Chief Judicial Magistrate Abhinav Pandey rejected the application, holding that it was maintainable neither in form nor in substance. The court noted that the plea failed to comply with procedural requirements under Section 175(4) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
The Magistrate observed that the application failed to name any specific public servant against whom allegations were being made, making it impossible for the court to identify or direct any “Officer Superior” to submit a status report.
Furthermore, the court struck down the alternative prayer seeking the registration of an NCR. The bench noted that the allegations leveled in the plea pointed to offenses such as wrongful restraint and wrongful confinement under Sections 126 and 127 of the Bharatiya Nyaya Sanhita, 2023, both of which are strictly cognisable offenses, rendering an NCR legally inapplicable.
Activists Intercepted During Arrival in Capital
Earlier, dramatic scenes unfolded at the Indira Gandhi International Airport when CJP activist Abhijeet Dipke, who was flying in from Mumbai to join the protest, posted a video on Instagram claiming that Delhi Police personnel intercepted and detained him and his associates right as their flight landed.
In the video circulating online, Dipke could be seen detailing the police action inside the aircraft cabin, alleging that officers had boarded the plane and lined the aisle to take them into custody before they could deboard. Calling the action arbitrary, Dipke criticized the deployment of police personnel directly inside a commercial airliner and questioned the authorities’ response to a peaceful protest demonstration.
Separately, the CJP released video footage featuring its legal head Ratna Singh, who claimed police officers restrained her from leaving her residence in her personal vehicle. The political group also claimed that popular content creator Dhruv Rathee had been detained during the crackdown, alleging that authorities were taking heavy-handed measures against youth voices questioning government actions.
Legal counsel representing the detained activists are expected to present their arguments during the magistrate hearing at the Delhi Cantt police station today.
