Amit Jogi Relief: In a significant development, the Supreme Court of India has granted major relief to Amit Jogi by staying his conviction and life imprisonment in the 23-year-old murder case of NCP leader Ram Avtar Jaggi.
The apex court also put a stay on the verdict delivered by the Chhattisgarh High Court, which had earlier found Jogi guilty and sentenced him to life imprisonment.
Background of the Case
The case dates back nearly 23 years and pertains to the murder of Ram Avtar Jaggi. Amit Jogi, son of former Chhattisgarh Chief Minister Ajit Jogi, had approached the Supreme Court challenging the High Court’s ruling.
The petition was heard on April 23, following earlier proceedings after April 20. Jogi argued that the High Court had acted unjustly by delivering its verdict in just 40 minutes without adequately hearing his side, relying primarily on the arguments presented by the Central Bureau of Investigation.
High Court Verdict and Appeal
On April 6, the Chhattisgarh High Court had convicted Amit Jogi and sentenced him to life imprisonment in the Jaggi murder case. Earlier, on April 2, the court had directed him to surrender within three weeks.
Challenging this decision, Jogi moved the Supreme Court, seeking relief from the conviction and sentence.
CBI Investigation and Earlier Trial
The case was handed over to the Central Bureau of Investigation in 2004 after Satish Jaggi, the son of the deceased, accused Ajit Jogi and Amit Jogi of orchestrating the murder.
The CBI later filed a supplementary chargesheet naming Amit Jogi as the alleged mastermind behind the killing. However, after trial proceedings between 2004 and 2007, a special CBI court in 2007 sentenced 28 accused to life imprisonment but acquitted Amit Jogi due to lack of evidence.
Reversal by High Court
Satish Jaggi challenged the acquittal in the Supreme Court, which subsequently directed the Chhattisgarh High Court to reconsider the case.
Upon fresh examination, the High Court overturned the trial court’s verdict, terming it flawed and inconsistent. The court observed that while other accused were convicted based on certain evidence, Amit Jogi had been acquitted on the same grounds.
The High Court held Amit Jogi to be the “mastermind” of the murder, noting his influential position as the son of the then Chief Minister and his alleged ability to influence the police machinery. It then convicted him and awarded life imprisonment.
Supreme Court Relief
Following this, Amit Jogi again approached the Supreme Court, which has now stayed both his conviction and life sentence, offering him interim relief in the long-standing case.
